Chief Justice Peter Underwood warned the jury they would be incontempt of court if they discussed the case with anyone during theweekend. Green was responsible for the building industry in his role asinfrastructure minister when he signed the deal with John Whitethen director of the TCC and a former Tasmanian HealthMinister. The deal was signed on the eve of last year’s Tasmanian stateelection without the knowledge of other Labor governmentministers. Clauses in the deal gave the TCC a three-year monopoly orcompensation. It prevented a minister exercising their lawful powerto authorise more than one organisation to accredit builders. During the trial the crown said Green would have known clausesin the deal would have prevented ministers from exercising theirrightful powers. The crown argued the deal was a “Labor mates” pact signed justbefore the election in case the government changed and resulted inTCC getting less business.
